These Terms of Service ("Terms") govern your use of the website firewallindustries.com and related services operated by FireWall Industries, Inc. ("FireWall," "we," "us," or "our"), including the FireWall Nexus™ presale reservation program. By using our website or placing a reservation, you agree to these Terms.

1. Presale Reservation Program

Nature of reservation. A presale reservation is an expression of interest in purchasing a FireWall Nexus™ system. Placing a reservation does not constitute a binding purchase agreement. A binding purchase obligation arises only upon execution of a separate purchase agreement between you and FireWall Industries.

Reservation deposit. The reservation deposit is $250 USD. This deposit is 100% refundable at any time prior to your execution of a purchase agreement. To request a refund, contact us at hello@firewallindustries.com. Refunds will be processed to the original payment method within 10 business days.

Reservation queue. Reservations determine install order within a deployment wave. Your position in the queue is based on the date and time your reservation is confirmed. FireWall Industries reserves the right to adjust deployment sequencing based on geographic logistics and site suitability.

2. Pricing

All pricing displayed on our website, including presale pricing, general availability pricing, and monitoring fees, is current as of the date of publication and is subject to change without notice. Final pricing, payment terms, and specifications will be disclosed in full before you are asked to execute a purchase agreement. You are under no obligation to proceed at the final price. If you choose not to proceed, your reservation deposit will be refunded in full.

3. Product Specifications and Performance

Product specifications, features, and performance characteristics described on our website represent current design targets based on our development and testing to date. These are subject to change as development continues. FireWall Industries does not guarantee that the final product will match all specifications shown on this website.

FireWall Nexus™ is designed to provide an additional layer of defense against wildfire ember exposure. It is not a substitute for home hardening, defensible space, evacuation planning, or compliance with local fire codes. No wildfire defense system can guarantee protection against all fire scenarios, and FireWall Industries does not make such claims.

4. Estimated Timelines

All shipping dates, deployment timelines, and development milestones described on our website are estimates provided for planning purposes only. Actual timelines may vary based on production scheduling, component availability, regulatory approvals, site assessments, and installation logistics. FireWall Industries will communicate material changes to reservation holders but is not liable for delays.

5. Eligibility and Site Assessment

FireWall Nexus™ deployment requires a professional site assessment to determine suitability. Not all properties may be eligible for installation. If your property is determined to be unsuitable for installation, your reservation deposit will be refunded in full. Initial deployment is limited to the western United States; geographic availability will expand over time.

All content on this website — including text, images, graphics, video, code, and design — is the property of FireWall Industries or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF YOUR RESERVATION DEPOSIT.

You agree to indemnify and hold harmless FireWall Industries and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our website or violation of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our website shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of such courts.

We may update these Terms from time to time. We will post any changes on this page and update the "Last updated" date. Material changes will be communicated to reservation holders via email. Your continued use of our website after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
